The E.O. serves as a new mechanism by which the administration is attempting to codify its policies currently facing legal challenges, including withholding grant payments to entire institutions, altering indirect cost rates, and terminating existing grant awards for “no longer effectuating agency priorities,” many of which the courts have already deemed as unlawful.

The EO is the latest attempt to subvert existing agency peer review processes while increasing executive influence in determining whether projects are funded or terminated.

The brief urges the court to deny the government’s request for a stay pending approval, emphasizing the immediate and irreparable harm caused by the termination of grants supporting early career scientists.

The mark for the NSF was $7 billion, a 24 percent reduction or $2.06 billion less than fiscal year 2025, and cuts the STEM education section from the bill.

FASEB, a GSA partner organization, sent a letter to leaders of the House and Senate Appropriations Committees urging them to reject the unprecedented cuts in the NIH and the NSF funding that were proposed in the administration's fiscal year 2026 budget request.

Although the ruling will not immediately reinstate terminated grants, FASEB views it as an important first step in ensuring that scientists underrepresented in biomedical research have access to funding to pursue research-intensive careers.
